| 23 January 2007 Artists’ Collecting Society Artists’ Collecting Society Collecting Droit de Suite on behalf of artists in the UK The Artists’ Collecting Society (ACS) has been set up in response to the EC’s Directive 2001/84/EC and new UK legislation on Artists’ Resale Rights (Droit de Suite), which provides an artist with a right to receive a royalty based on the price obtained for any resale of an original work of art, subsequent to the first transfer by the artist. ACS is an independent collecting society, established to collect resale royalties for British artists in the UK. The aim of the society is to provide artists with an alternative agency which maximises the revenue due to them from Droit de Suite, whilst minimising interference in the art trade, and by so doing, best protecting their future livelihoods. ACS will be run on a not-for-profit basis, to maximise the amount of payment back to member artists from the resale of their works. We will support the art trade through our commitment to three core values: 1. Administrative fees ACS will charge an administration fee of 15%. The Society will always only retain the amount of money required to service administration and collection/distribution of the royalty. 2. Transparent procedure ACS will offer significant clarification to the art trade by specifying exactly which artists it represents. Dealers and auction houses will be informed of the list of artists registered with ACS (and additions over time) through email and post, and this list of artists will be maintained on a dedicated website. This will make the collection and payment procedure simple and transparent for the art trade since they will be able to identify easily which sales they need to report. 3. Support from the art trade The motivation for ACS has been driven by a request from artists represented by the Society of London Art Dealers (SLAD) and the British Art Market Federation for a choice of collecting society for Artists’ Resale Right.
